Terms of Service

These terms govern the use of Kyren Tech services, including website design, brand identity, digital presence systems, care plans, and related support.

1. Services

Kyren Tech provides website design and development, brand identity systems, website care plans, digital presence add-ons, and related support services. The exact deliverables for each project are defined in the proposal or scope of work agreed before the project begins.

2. Proposals and scope

Every project begins with a written proposal or scope of work. This may include the deliverables, timeline, revision rounds, pricing, payment schedule, and any third-party services required. Work outside the agreed scope may be quoted separately before it begins.

3. Payments

A minimum advance payment is required before work begins, unless stated otherwise in the proposal. The remaining balance is due before the final website, files, or deliverables are handed over, published, or transferred.

Kyren Tech may accept payments by bank transfer, UPI, Razorpay, Skydo, PayPal, card, or other approved payment methods. International payments may be accepted in INR or suitable foreign currency equivalents, depending on the agreed proposal.

Unless stated otherwise, prices are exclusive of applicable taxes, payment-gateway fees, currency conversion fees, or bank charges. These may be added where required.

4. Timelines and client inputs

Estimated timelines are shared in the proposal. Project timelines depend on timely client inputs, including content, brand assets, feedback, approvals, login access, and payment completion. Delays in client input may extend the delivery timeline.

5. Revisions

Each package includes the revision rounds stated in the proposal. Additional revisions, new pages, major design changes, new features, or work outside the agreed scope may be charged separately. Any additional charges will be communicated before the extra work proceeds.

6. Ownership and handover

After full payment is received, the client owns the final approved website design, content, and brand assets created specifically for their project, subject to any third-party licences, tools, platforms, fonts, plugins, software, or stock assets used.

Depending on the package, handover may include website access, relevant files, documentation, and reasonable guidance to manage the website. Domains should be registered in the client's name wherever possible.

Kyren Tech may showcase completed work in its portfolio, website, social media, or sales material unless the client requests otherwise in writing.

7. Hosting, domains and third-party tools

Kyren Tech may help purchase, manage, configure, or maintain hosting, domains, business email, analytics, forms, security tools, plugins, software, or other third-party services.

Third-party services are subject to the provider's own pricing, renewal terms, refund rules, downtime, outages, changes, and policies. Kyren Tech is not responsible for third-party platform outages, pricing changes, policy changes, or service limitations.

Where Kyren Tech purchases third-party services on the client's behalf, those costs may be billed in advance or included in the agreed plan. Once paid to the provider, such third-party costs are usually non-refundable.

8. Care plans and recurring services

Care plans, retainers, hosting support, maintenance, SEO support, content support, reporting, and other recurring services are billed in advance as stated in the proposal.

Some plans may include a minimum commitment period. During that period, the plan cannot be cancelled for convenience unless agreed in writing. After the minimum term, cancellation may require 30 days' written notice.

When a care plan or recurring service ends, Kyren Tech is not required to continue maintaining, paying for, renewing, or supporting third-party services unless a new agreement is in place. If the client does not take over required services, the website, email, forms, integrations, or related features may stop working after the paid period ends.

9. Refunds and cancellations

Advance payments cover discovery, planning, design direction, setup, communication, reserved time, and early project work. Once work has commenced, advance payments are generally non-refundable.

"Work has commenced" includes any discovery call, strategy work, design work, development work, setup work, communication, or third-party purchase made for the project.

If a project is cancelled before work begins, a refund may be considered after deducting payment-gateway charges, transaction costs, and any non-refundable third-party costs already incurred.

If a project is cancelled after work begins, completed work, milestone payments, and third-party costs are non-refundable. Any deliverables completed up to the point of cancellation may be handed over once outstanding dues and third-party costs are cleared.

If a refund is approved, payment-gateway fees, bank charges, currency conversion differences, taxes, and third-party charges are not refundable.

Refunds, cancellations, care plans, recurring services, and third-party costs are governed by our Refund & Cancellation Policy.

10. Late or failed payments

If a payment is overdue, Kyren Tech may pause work, delay handover, restrict support, or suspend services until payment is received. Where third-party services are unpaid or overdue, the related website, email, hosting, or integrations may be affected.

11. Inactive or abandoned projects

If the client does not respond, provide required inputs, or approve work for 30 consecutive days despite reasonable follow-up, the project may be treated as paused or abandoned. Resuming the project later may require a revised timeline, additional charges, or a fresh quote.

12. No guaranteed outcomes

Kyren Tech does not guarantee specific leads, sales, revenue, rankings, traffic, bookings, or business outcomes. The work is designed to improve digital presence, clarity, credibility, user experience, and enquiry flow. Results depend on multiple factors outside website design alone.

13. Governing law

These terms are governed by the laws of India. Any disputes will be subject to the jurisdiction of the courts in Thane, Maharashtra, India.
